Public tenders in Brazil must follow the law, there is no room for discretion, those involved must also base their behaviour on Administrative and Constitutional Principles; the public interest must always prevail. In public tenders, those involved must always seek advantages for public bodies, acquisitions and contracting require planning and budgeting, acquiring only what is necessary without waste and avoiding superfluous stocks and misuse of purpose. Public institutions are totally dependent on the laws that deal with public tenders, which is why we sought to summarise the main topics on the concepts and procedures of Laws 8.666/93 and 12. 462/11, the latter also known as the Differentiated Public Procurement Regime (Regime Diferenciado de Contratações Públicas - RDC), which initially came into being to speed up the bidding processes related to some sporting events in Brazil that were to begin in 2013, later extending the application of this law to other situations. It is hoped that the RDC will be properly utilised and will be able to achieve its objectives, providing the Public Administration with the expected advantages.
