Australian Public Health Law: Contemporary Issues and Challenges explores the changing scope of public health law in Australia. In 26 chapters, written by leading scholars, this innovative collection analyses the role of law and regulation in supporting health and safety for the community. The chapters consider the historical, constitutional and global foundations of contemporary public health law, as well as the role of consumer protection law in protecting public health. Increasingly, public health law is informed by human rights law. The chapters explore the intersections between public health law, rights and ethics, analysing the role of human rights law for Indigenous health equity, access to medicines, public health dimensions of mental health law, and genomics and public health law. Control of communicable diseases has long been a focus for public health law. The book’s chapters analyse the Australian legal and regulatory frameworks for infectious diseases control, the role of law in preparing for and responding to pandemics, vaccination laws and the regulation of sex work. Increasingly, public health law has an important role in addressing non-communicable diseases, with law’s role in this area analysed in chapters on alcohol, food regulation, tobacco control and regulation of illicit drugs. The expanding scope of contemporary public health law is also illustrated through consideration of the public health aspects of workplace health and safety law, environmental law, the public health dimensions of natural disasters, and the relevance of coronial investigations for developments in public health law. Increasingly the rights and needs of specific groups, including children and older persons, are recognised within public health law. Australian Public Health Law: Contemporary Issues and Challenges identifies the scope of Australian public health law and charts a course for its future evolution.
